Welcome to Mycarrio Privacy Policy: This document is an electronic record that require publishing the rules and regulations, privacy policy, and Terms & Conditions of Use for access and operation of the www.mycarrio.com and www.mycarrio.lu website and the "Mycarrio" software application (hereinafter, for brevity, referred to as "the Platform") designed for mobile and hand-held devices. The Platform is owned and managed by Kichilli tech sarl-s Rcs: B272941, and Tva: 20222478309 and having its principal seat of business and registered office at 6a avenue des hauts-fourneaux, 4362 esch-sur-alzette, Luxembourg. For the purpose of these Terms & Conditions of Use, wherever the context so requires, "you", "user", or "User" shall mean and imply any natural person or legal entity who shall access, operate, transact, and utilize the logistical services offered by Kichilli tech sarl-s. via the Platform, by providing registration data and registering on the Platform as a registered User using any particular computer system. The terms "Mycarrio", "we", "us" or "our" shall mean, unless the context otherwise required, KICHILLI TECH SARL-S.
By clicking on "Yes, I Agree", you agree, undertake, and affirm that your use of the Platform shall be strictly governed by the following binding and enforceable principles: Mycarrio reserves the right to modify the terms and conditions related to its services at any time. Any changes made will take effect once they have been posted on Mycarrio's website or in the specific service's policies or supplemental terms. By continuing to use the services after these updates have been posted, you are agreeing to be bound by the updated terms and conditions. To access most services provided by Mycarrio, you need to have a personal user account with the platform, which requires registering by submitting personal information such as your name, address, mobile number, and age, as well as a valid credit card. You must be at least 18 or the legal age in your jurisdiction. You must keep your account information up-to-date, and failing to do so may result in a termination of the agreement with Mycarrio. You are responsible for all activities under your account and must maintain the security and confidentiality of your username and password. You can only have one account unless otherwise authorized by Mycarrio in writing.
The Services are not intended for use by individuals under 18 years of age. You cannot allow others to use your account or provide moving or logistics services to anyone under 18 without accompanying them. You cannot transfer your account to any other person or entity. When using the Services, you must comply with all relevant laws and only use the Services for lawful purposes. Your use of the Services must not cause any nuisance, annoyance, inconvenience, or property damage. Mycarrio may ask you to provide proof of identity to access or use the Services, and your access may be denied if you refuse.
Please note that the Mycarrio app is intended for on-demand moving and delivery of items, not for transportation of individuals. Any driver who transports a user during a transaction does so under their own personal insurance and liability, which is not a service provided by Mycarrio. Use caution and exercise good judgement before getting in a vehicle with another person, as it breaches your agreement with Mycarrio. By registering for an account, you consent to receiving informational SMS messages as part of the standard operation of the Services. Please note that choosing not to receive SMS messages may affect your use of the Services.
Booking, Pricing : The booking can be made by the mycarrio website or through the application, or by email or by phone calls. KICHILLI TECH SARL-S does not own the fleet or the person who does the moving or delivery. The company connects you to the nearest team (third parties) who has the skills to do the moving, delivery, or any handyman job. Kichilli tech sarl-s is a marketplace for moving and delivery, and other handyman jobs. Once the booking has been made, the driver/team will come to the requested location and then do the job. The payment has to be made immediately after the work, through the payment method available. The client agrees to pay the transportation and storage fees as specified in the agreement immediately after the moving through the app. The price distribution is shown in the pricing section on the app, and we use the Google Maps Platform API to compute distance for pricing calculation. By using the Services, you may incur charges for the services received from a Third-Party Provider. Mycarrio will handle payment of these charges on behalf of the Third-Party Provider as their limited payment collection agent using the payment method designated in your account, and a receipt will be sent to you via email. The payment of these charges through Mycarrio is equivalent to paying the Third-Party Provider directly. The charges include applicable taxes as required by law and are final and non-refundable, unless otherwise specified by Mycarrio. You have the right to request a lower charge from the Third-Party Provider at the time of receiving the services, and Mycarrio will respond to any such request to adjust the charges.
Insurance : The company will provide standard insurance coverage for the goods in transit. The client may request additional insurance coverage at their own expense. Liability : The company is not liable for any damages to the goods except for damages caused by its own negligence or intentional acts. The client agrees to indemnify and hold the company harmless from any third-party claims arising from the transportation or storage of the goods.
Confidentiality : The company agrees to maintain the confidentiality of all client information and will not disclose it to third parties except as required by law. Dispute Resolution: In the event of a dispute, claim or controversy regarding the Terms, their enforcement or validity, or the use of the Services, it will be resolved through binding arbitration between you and Mycarrio. However, each party has the right to bring an individual lawsuit in small claims court or seek legal action in a competent court to protect their intellectual property rights. You and Mycarrio both waive the right to a jury trial and participation as a plaintiff in a class action. The arbitrator cannot consolidate multiple claims and cannot preside over a class or representative proceeding unless both parties agree in writing. If this paragraph is not enforceable, the entire "Dispute Resolution" section will be void. The "Dispute Resolution" section will remain effective even after termination of the Terms.
Governing Law : The agreement will be governed by and construed in accordance with the laws of Luxembourg.
